
The Dutch Gambling Authority, Kansspelautoriteit (KSA), has contacted multiple online sports betting operators over how they present information related to “early payout” features, citing gaps in disclosures to players.
The regulator said the feature, which allows a wager to be settled as a win before a match has concluded, was not always explained in a way that clearly outlined its limitations, particularly in relation to draw bets.
How early payout works
Early payout functions offered by certain operators allow a bettor to have a wager declared a winner if their selected team takes a two-goal lead during a match, regardless of the final outcome. The option enables players to secure a confirmed, though lower, return prior to the final whistle.
The odds attached to early payout wagers are lower than those for standard bets. The mechanism does not apply to wagers on a draw, as no team holds a lead in that scenario.
According to the KSA, issues arise when marketing or interface design gives the impression that early payout could extend to draw outcomes.
“The providers’ terms and conditions state that early payouts are not possible for draws, but this isn’t always clearly communicated when placing the bet,” The KSA said. “This creates confusion among players, who may assume that early payouts also apply to draws.”
“Providers are required to provide clear and understandable information about the possible outcomes of a bet, including the associated terms and conditions. The KSA determined that providers were not complying with this obligation when providing information about the ‘early payout’ feature. Providers that offer this feature have been contacted and have improved their communication so that players are now more clearly informed about the limitations of early payout for bets on draws.”
Transparency obligations under Dutch law
Under Dutch gambling regulations, licensed operators must present clear and understandable information about all potential betting outcomes and the related terms and conditions.
The KSA said several providers failed to communicate sufficiently that early payout does not apply to draw bets. In some instances, operators promoted lower odds tied to early payout on draw selections, even though the feature was not available for those outcomes. In certain cases, this restriction was not clearly communicated at the point of placing the bet.
As a result, players could have formed the impression that early payout would be available for draw wagers, potentially leading to misunderstanding.
KSA said the operators involved have since been contacted and have updated their communications to clarify that early payout is not applicable to draw bets.
