Brazil’s Ministry of Finance has opened a 45-day public consultation on proposed changes to the authorization process for fixed-odds betting operators, as the government takes additional steps to increase transparency in the country’s regulated gambling market.
The contribution period will run from July 27 to September 9, 2026. Individuals and legal entities may submit comments through the Brasil Participativo Portal using a gov.br account. After the consultation closes, the Secretariat of Prizes and Bets, or SPA, will analyze the submissions under Article 31 of Decree No. 12,002/2024.
The consultation follows the Ministry of Finance’s publication earlier this week of Administrative Order No. 2,126, which established a task force responsible for ensuring transparency in gambling company licensing procedures. In June, Finance Minister Dario Durigan also announced that the ministry would publish more than 25,000 documents connected to betting authorization processes, describing the disclosure as part of the government’s transparency commitment.
Public Consultation Notice SPA/MF No. 3/2026 was published in the Federal Official Gazette on July 22, in Edition 136, Section 3, Page 182. The notice was issued by the Ministry of Finance’s Secretariat of Prizes and Betting.
The notice states: “Art. 1. A public consultation is hereby opened to gather contributions and information for the drafting of the Ordinance that will establish the rules and conditions for obtaining authorization to commercially operate the fixed-odds betting lottery modality.”
The SPA is seeking information and contributions to support the drafting of an ordinance establishing revised rules and conditions for obtaining commercial authorization to operate sports betting and online games in Brazil. The review is intended to improve the authorization application procedure currently set out in SPA/MF Ordinance No. 827/2024.
Ordinance No. 827 regulated provisions of Brazil’s betting legislation covering the requirements and conditions for authorizing betting businesses. The SPA plans to incorporate lessons from the first authorization cycle when preparing the revised framework.
The regulatory review was included in the SPA Regulatory Agenda established through Ordinance No. 817 in April 2025. That agenda anticipated a review of betting operator authorization procedures during the first quarter of 2026, although the consultation was not placed online until July.
The secretary issued the notice under the authority provided by Article 55, caput, item I, of Annex I to Decree No. 11,907 of January 30, 2024. It also cites Law No. 13,756 of December 12, 2018, Law No. 14,790 of December 29, 2023, and Article 29 of Decree No. 12,002 of April 22, 2024.
The consultation is intended to allow public input before the government completes the regulation defining the authorization requirements for the commercial operation of the fixed-odds betting lottery modality.
